There has been a new twist in the dispute regarding the property of late industrialist Sanjay Kapoor. Senior lawyer Mahesh Jethmalani has launched a scathing attack on Priya Kapoor’s claims after the Delhi High Court commented on the “suspicious circumstances” on the will.

In an interview given to an English news channel, Mahesh Jethmalani said, “There was no need to make a false will. When someone becomes excessively greedy, then such dangers arise.”

Jethmalani is advocating on behalf of Sanjay Kapoor and Karisma Kapoor’s children Samaira and Kiaan Kapoor. He says that Priya Kapoor and her minor son had already got the rights of about Rs 7500 crore under the trust structure. In such a situation, making additional claims through the disputed will was an “unnecessary and risky step”.

Not 30 thousand crores, assets worth around 12 thousand crores

Mahesh Jethmalani made a big claim on the total value of the property. He said that the discussion of Rs 30 thousand crore in the media is wrong. According to him, the total estate is worth about Rs 12 thousand crores, of which about Rs 10 thousand crores are trust assets and about Rs 2 thousand crores are related to wills. He said that making the matter controversial for such a small stake is beyond comprehension.

If the will is proved to be fake then everything can be lost

Jethmalani said that if the will is proved to be fake in court, it could have serious legal consequences. According to the trust deed, if a person is convicted of a crime involving “moral turpitude” such as fraud, he is no longer eligible to become a trustee. He may also lose his right to be a beneficiary of the trust. He called it a “huge gamble.”

Claim of removal of Priya Kapoor from the post of trustee

Mahesh Jethmalani claimed that permanent trustee Rani Kapoor has already removed Priya Kapoor from the post of trustee. He said his clients are not challenging the validity of the trust, but are raising questions about Priya Kapoor’s behavior and the way the trust is run.

Accused of not giving information to children

Jethmalani alleged that there was a lack of transparency in the trust administration. He said that there was delay in giving necessary information related to the trust to Adaira and Kiyan. According to him, these issues will be covered in detail in the upcoming legal documents.

Delhi High Court has already expressed doubt

The entire controversy became more serious when the Delhi High Court, citing suspicious circumstances regarding the will, ordered the estate to be kept safe. The court has currently banned major transactions or changes related to property.
